Tenant Damage vs Fair Wear and Tear: What’s the Difference?

At the end of a tenancy, disputes often arise over what’s considered “damage” and what’s just fair wear and tear. Here’s how New Zealand law defines it.

Fair Wear and Tear

This includes deterioration that happens through normal use:

  • Faded curtains
  • Worn carpets in high-traffic areas
  • Minor scuff marks on walls

Tenants are not liable for wear and tear.

Tenant Damage

This is anything caused by carelessness or intentional actions:

  • Stains, burns, or holes in carpet
  • Broken windows
  • Damage from pets not approved

Tenants may be liable for the cost of repairs, especially if it’s not accidental.
