Ending a tenancy early — whether by a landlord or tenant — can be tricky but from Rentall’s perspective, we always look to be pragmatic and create the environment for amicable conversations to be held. Here’s what New Zealand law says and how to manage the process properly.

Tenants Wanting to Leave Early

Tenants in a fixed-term tenancy cannot end the agreement early without:

  • The landlord’s written consent
  • Or an order from the Tenancy Tribunal (in exceptional cases)

Otherwise, they may be liable for:

  • Ongoing rent until a new tenant is found
  • A break fee to cover advertising or admin costs

Landlords Ending a Tenancy Early

Landlords also cannot end a fixed-term tenancy early unless:

  • By mutual agreement
  • For Tribunal-approved reasons (e.g. serious tenant breaches)

For periodic tenancies, 90 days’ notice is required (or 63 days in certain cases like moving in or selling).
